UWish is a rewards platform that empowers the next generation of leaders through financial literacy edutainment. At the heart of our mission is building a platform that's designed for everyone, so we've done our best to communicate our terms and conditions in the simplest, more accessible format here. Please read carefully before using our service.
It’s great to have you as a part of our community. These Terms, along with the linked policies, govern your use of our services – the website (https://uwishco.com/), app, and related software or features (collectively referred to as the “Platform” or “UWish”). When we use terms like “we,” “our,” or “us” in these Terms, we’re talking about The UWish Company LLC. By using UWish, you’re agreeing to these Terms & Conditions (“Terms”) as well as the additional policies linked through our Terms and on the Platform. Please take the time to read these Terms carefully, and feel free to reach out to us if you have any questions. If you don’t agree with these Terms, please don’t use UWish.
UWish is continuously evolving and improving our Platform. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective is taken as your acceptance of the revised Terms. If you don't agree to the new terms, in whole or in part, we ask that you please stop using UWish and delete your account.
By placing an Order for Goods through the Platform, you warrant that you are legally capable of entering into binding contracts. Note that all orders are subject to our Shop UWish Terms and Conditions.
To create an account and become a UWish user, you must be at least 18. If you are under the age of 18, you must have a parent create an account on your behalf with permission. ZYou're responsible for your account and ensuring it is only used in a lawfully legal way. When you create an account, you agree to comply with these Terms and that you've over 18 and legally able to enter into these Terms with UWish. You must provide us with accurate info about yourself — if anything changes, please let us know so we can update your details.
You’re responsible for anything that happens to your account, so keep your login details and password safe and don’t share them with anyone. If you think your account has been compromised, please contact us immediately at hello@uwishco.com. You must not assign or transfer your account to someone else or use your account (or allow it to be used by anyone) in a way which in our reasonable opinion, causes damage to UWish or our reputation, or infringes another’s rights or applicable laws and regulations.
We truly love the variety of content that our community of users post on UWish! However, we want to ensure that everyone who visits the Platform can have a safe and family-friendly experience. To do these, we've set some standards for what content is and isn't allowed on UWish, so please make sure you follow them, otherwise we may suspend or permanently remove your account.
When we talk about your "content", we mean the photos, videos, links, text and any other materials you post on the UWish Platform. You're responsible for your content and you warrant that:
Violation of this policy will result in immediate account suspension and potential removal from the Platform. Since laws and regulations can vary across the countries we operate in, we might ban or remove content that is considered legal in any of the countries we operate it, even if it's legal in others. We reserve the right to take appropriate steps to keep UWish safe for everyone, including restriction of access or complete removeal of content.
Despite our best efforts, you may find offensive, indecent, incorrect or objectionable, and you agree that under no circumstances will UWish be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.
At UWish, we take the respect for intellectual property rights very seriously. It's part of our commitment to ensure that all content on our Platform respects the legal rights of others.If you hold a copyright or are acting on behalf of a copyright owner, and you believe that a work has been copied in a manner that infringes on your rights through our Platform, we encourage you to let us know.
Please send your written notice to our copyright agent at hello@uwishco.com. In your message, include a detailed description of the alleged infringement for us to review.
It's important to note that there could be legal repercussions, including potential costs and attorney's fees, for falsely claiming that content on our Platform infringes your copyright. We ask for your diligence in this matter to maintain the integrity of our Platform and the rights of all involved.
If you believe that your copyright has been infringed upon on our Platform, you can submit a notification under the Digital Millennium Copyright Act (DMCA). To do this, provide our Copyright Agent with the following information in writing, as outlined in 17 U.S.C 512(c)(3):

Our Platform may include links to websites or services operated by third parties, which are not under the ownership or control of UWish.
UWish does not have any control over the content, privacy policies, or practices of these third-party websites or services. By using our Platform, you acknowledge and agree that UWish is not responsible or liable, either directly or indirectly, for any damage or loss caused, or alleged to be caused, by or in connection with your use of or reliance on any content, goods, or services available through these external sites or services.
We highly recommend that you carefully review the terms and conditions and privacy policies of any third-party websites or services that you access through our Platform. It's important to stay informed about how they might handle your data or interact with your device.
UWish reserves the right to terminate or suspend your account at any time, without any prior notice or liability, for any reason, especially if you breach our Terms and Conditions.
Should your account be terminated, your access to use our Platform will end immediately. If you decide that you want to terminate your account with us, you can do so by simply stopping your use of our Platform.
At UWish, we grant you a limited right to use our Platform for sharing your content and engaging with what others have posted. However, it's important to note that we don't oversee the content, products, or services available through other users' profiles.
The intellectual property rights of the Platform, excluding your content (referred to as "UWish IP"), are exclusively owned by UWish or our licensors. You must understand that you do not acquire any rights in the UWish IP and are not permitted to use it, including our brand name or logo, without our prior written consent. This is particularly relevant for any use that might suggest a partnership or endorsement by UWish.
As a UWish user, you are provided with a limited, revocable, non-exclusive, and non-transferable right to use the Platform. This includes creating, displaying, using, playing, and uploading content in line with our Terms.
We ask that you do not alter, hide, or remove any proprietary notices or trademarks on the Platform. Activities such as copying, reproducing, distributing, licensing, selling, reselling, modifying, translating, disassembling, decompiling, decrypting, reverse-engineering, or attempting to derive the source code of the Platform or any part of it are strictly prohibited.
Sometimes things don't work out as planned. If a part of these Terms turns out to be unenforceable or invalid, don't worry. We'll tweak that part to reflect the original intent as much as the law allows. The rest of the Terms? They'll continue as usual, full steam ahead.
If we don't immediately ask you to follow a part of these Terms, or if we don't exercise a right right away, that doesn't mean we've given up those rights. We can still ask you to comply or exercise our rights in the future. Also, if we overlook a breach of these Terms once, it doesn't mean we'll overlook it every time.
We're all about making UWish the best it can be, and your suggestions are a big part of that. Sometimes, we might roll out some "beta" features – these are like test runs, and we'd love to hear what you think about them. Just so you know, when you share your thoughts with us, we might use your ideas to improve UWish, and we won't be able to pay you for them (or we might decide not to use them at all). It's all about working together to make something great!
Also, from time to time, we might give you a sneak peek at some new stuff we're trying out on UWish in a "beta" phase. This is our way of testing and fine-tuning. Remember, these beta features are still in the experimental stage, so they might not be quite as polished or reliable as the rest of UWish. But with your help, we can make them better!
In understanding our liability and remedies related to UWish, it's important to note that our entire liability, as well as that of our suppliers, under any provision of these Terms, is limited. Should there be any issues, your exclusive remedy will be capped at the total amount you have actually paid for using our Platform, or $100 USD if you haven't made any purchases through UWish.
We also want to clarify that, to the maximum extent permitted by law, neither UWish nor our suppliers will be liable for any indirect damages. This includes, but is not limited to, loss of profits, data loss, business interruption, personal injury, or loss of privacy resulting from or in any way connected to the use or inability to use the Platform, any third-party software, or hardware.
However, it's essential to recognize that legal standards vary by region. In some states or jurisdictions, limitations on implied warranties or the limitation of liability for incidental or consequential damages are not allowed. In such cases, the liability of UWish and our suppliers will be limited to the greatest extent permitted by applicable law.
At UWish, we're all about transparency, so here are a few important things to keep in mind. When you're using our Platform and diving into the content, you're doing that at your own risk. We provide UWish "AS IS" and "AS AVAILABLE," which means we don't offer any specific promises or guarantees about the Platform. This includes things like constant up-time, availability, or any implied warranties like suitability for a certain purpose, non-infringement, or how well the Platform performs.
We at UWish, along with our affiliates and licensors, can't make any guarantees that:
These Terms are as broad as the law allows. We're not trying to limit or ignore any legal rights you might have that can't be waived or altered by a contract. If the rules of the United States Consumer Protection Law apply here, and if we don't meet a consumer guarantee, our duty to you is limited to either giving you the service again or paying you back for it.

Within our Platform, we might offer access to certain third-party features or services, like a payment gateway or an online shopping interface. It's important to note, unless we explicitly say so, we don't officially endorse or guarantee any third-party products or services. Also, we don't handle refunds for transactions made with these third parties.

If you don't accept or stick to these third-party terms, it could lead to the suspension, cancellation, or limitation of your account, or restrict your access to these services on our Platform.
